ATHLETIC WAIVER OF LIABILITY AND HOLD HARMLESS AGREEMENT

There are certain inherent risks associated with participating in sports and /or athletic training that cannot be eliminated. These risks include, but are certainly not limited to: (1) minor injuries such as scratches, cuts, bruises and strains; and (2) major injuries such as injuries to the eyes, infection, loss of sight, joint injuries, back injuries, heart attacks, concussions, paralysis and even death. Also included in these risks are the same or similar injuries that might result from using training equipment, actual use of a field or training facilities, the acts of others or from the unavailability of emergency staff or emergency medical care (hereinafter we shall define all of these risks and potential injuries as "Risks"). All of these Risks will be present in the activities that you and/or your minor will be participating in with IN SZN LLC (the "Activities"). HAVING READ THIS PARAGRAPH and having an appreciation for and an UNDERSTANDING OF THESE RISKS, you hereby affirm that you and/or your minor's participation in these Activities is voluntary and that you agree on behalf or yourself or your minor to all of the following:

1. ASSUMPTION OF RISK I, on behalf of myself and /or my minor, ASSUME ALL OF THE RISKS THAT MAY OR CAN ARISE OUT OF PARTICIPATING IN THE ACTIVITIES, INCLUDING BUT NOT LIMITED TO THE ATHLETIC ACTIVITY ITSELF, USE OF THE EQUIPMENT, FIELD OR FACILITIES, THE ACTS OF OTHERS OR THE UNAVAILABILITY OF EMERGENCY CARE, as well as those Risks described in the preceding paragraph.

2. INDEMNITY/HOLD HARMLESS 1, on behalf of myself and /or my minor and/or our heirs, personal representatives and/or assigns, also agree to indemnify and hold IN SZN LLC, as well as their affiliates, parents, subsidiaries, assigns, partners, attorneys, members, employees, independent contractors, shareholders, officers, directors, and agents or any producers, investors, cast members or any other person or entity associated in any way with the ownership, operation or affiliation with recreational facilities and the creation, production or distribution of IN SZN LLC-related marketing content on any IN SZN LLC-owned website, harmless from any and all claims, causes of actions, lawsuits, arbitrations or proceedings as well as from any expenses, judgments, costs, fees, damages, expenses and/or liabilities, including attorneys' fees incurred in defending or prosecuting any such claims brought against IN SZN LLC as the result of my or my minor's participation in the Activities.

I hereby allow IN SZN LLC to use my or my minor's image or likeness without current or future compensation for marketing purposes related to IN SZN LLC.

3. RELEASE/WAIVER In consideration for being permitted to participate in the Activities, I, on behalf of myself and /or my minor and/or our heirs, personal representatives and assigns HEREBY RELEASE, WAIVE AND DISCHARGE IN SZN LLC from any and all liability associated with or related to my or my minor's participation in the Activities and agree NOT TO SUE IN SZN LLC for any reason resulting from or associated with my or my minor's participation in the Activities. This waiver and release is intended to include all claims for injuries, accidents, illnesses, or property loss, whether known or unknown or anticipated or unanticipated, which are in any way related to or associated with the Activities.

4. NO INSURANCE I, on behalf of myself and /or my minor, acknowledge that IN SZN LLC does not carry insurance on behalf of myself or my minor.

5. LEGAL RIGHTS I, on behalf or myself and/or my minor, understand and acknowledge that I/we are surrendering valuable legal rights in this agreement.

6. SEVERABILITY I, on behalf or myself and/or my minor, understand and expressly agree that this agreement is intended to be as broad and inclusive as permitted by the law of the State for which it is used and that if any portion of this agreement is held invalid, it is agreed that the balance of the agreement shall continue in full force and effect and that whatever portion is held invalid shall be interpreted and construed to afford as much protection to IN SZN LLC as permitted by the applicable law.

FOR PARTICIPANTS OF MINORITY AGE - (UNDER AGE 18 AT THE TIME OF REGISTRATION)

CONSENT AND RELEASE ON BEHALF OF MINOR

I am the parent and/or legal guardian of the above named minor participant. I have read this agreement thoroughly and understand all of the terms. I understand that I am surrendering legal rights on behalf of the minor and myself. I, on behalf of myself and my minor, agree to be bound by all of the terms of this agreement and also give my consent to allow my minor to participate in the Activities described herein. I release and agree to indemnify and hold harmless the Releasers from any kind and all liabilities incident to my minor child's involvement or participation in these programs as provided above, even if arising from the negligence of the releases, to the fullest extent permitted by law.

Terms & Conditions

IN SZN LLC & IN SZN ATHLETICS

1. Registration & Late Fees

Late Registration Fee: A non-refundable late fee will be added to the total player registration fee for any registrations completed after the official registration window closes. No exceptions will be granted.

Roster Spot Reservation: Registration is not final, and player spots are not guaranteed until full payment (or an approved payment plan arrangement) is completed.

2. Refund & Credit Policy

Eligible Refunds: A full or partial refund will be issued upon written request for players who:

Have not been present for an official roster check; and

Have not participated in any gameplay or team practices.

Refund Request Deadline: Refund requests must be formally submitted in writing prior to the start of Week 3 of the season. Any refund request submitted after Week 3 will be processed solely as a seasonal credit toward future programs.

Ineligible Refunds: Refunds will not be issued to players who:

Have been present for an official roster check; or

Have participated in gameplay or practices (including players who become injured after having participated in gameplay).

Program Cancellation: If IN SZN LLC or IN SZN ATHLETICS cancels a program or season in its entirety due to facility constraints or unforeseeable issues, a full refund or prorated credit will be issued to all affected participants.

3. Code of Conduct & Sportsmanship

Behavior Expectations: Zero tolerance is enforced for verbal or physical abuse, unsportsmanlike behavior, harassment, taunting, or threats directed toward referees, staff, coaches, players, or spectators.

Disciplinary Action: IN SZN LLC or IN SZN ATHLETICS reserves the right to issue warnings, technical fouls, game forfeits, or immediate ejection/suspension from the league without refund for any Code of Conduct violations.

Official Authority: Game officials and field managers hold final authority over game rulings, spectator sideline conduct, and field safety enforcement.

4. Media Release & Consent

Photographic & Video Authorization: By participating, participants (and legal guardians of minor participants) grant IN SZN LLC, IN SZN ATHLETICS, and designated media personnel the right to capture, record, edit, and publish photographs, audio, and video coverage taken during league events.

Promotional Usage: Media content may be utilized across digital platforms, social media, marketing materials, website galleries, and promotional campaigns without royalty payments or compensation.

5. Liability & Medical Authorization

Assumption of Risk: Athletic programs and flag football involve inherent risks of physical injury. Participants and guardians assume all risks, hazards, and dangers incidental to participation.

Waiver of Liability: Participants and guardians release and hold harmless IN SZN LLC, IN SZN ATHLETICS, facility hosts, officers, employees, referees, and volunteers from liability for personal injury, property damage, or loss incurred during events.

Emergency Medical Care: In the event of an injury or medical emergency, staff are authorized to seek standard emergency medical treatment or transport for the participant if the parent/guardian cannot be reached immediately.

6. Equipment & Uniform Standards

Required Gear: All players must adhere to format equipment rules (e.g., pocketless shorts, official team jerseys, approved flag belts).

Illegal Equipment: Metal cleats, jewelry, or unapproved alterations to equipment/flags are strictly prohibited during competition.

7. Weather & Schedule Adjustments

Inclement Weather & Cancellations: Field safety is our priority. Games delayed or canceled due to weather, lightning, or severe field conditions will be rescheduled whenever possible.

Makeup Games: While every effort will be made to reschedule postponed games, IN SZN LLC or IN SZN ATHLETICS does not guarantee makeups if severe weather or venue limitations prevent rescheduling. Refunds are not issued for weather-related cancellations.

8. Governing Law

These Terms & Conditions are governed by and construed in accordance with the laws of the State of Arizona. Any legal disputes or claims shall be resolved in the appropriate jurisdiction located in Pima County, Arizona.
